Sales and Purchases

The WMD Property Group can provide advice on all commercial conveyancing matters. There are marked differences between commercial and residential conveyancing, whether selling or purchasing offices, factories, industrial sites or retail shops it is critical that you are advised by lawyers who have experience in this area.

The WMD Property Group can advise you in relation to the sale or purchase of any commercial property, especially in circumstances where the sale or purchase of the property is interdependent with the sale of the business which operates from the property. Our lawyers have extensive experience in drafting and negotiating contracts for the sale of land or property for commercial purposes.

The WMD Property Group can also advise you in relation to any additional matters that arise in conjunction with the sale or purchase of the commercial property such as the assignment of leases of the property or the type of purchasing entity.

GST Issues

The WMD Property group can advise you of the GST implications arising from the sale or purchase of commercial property. Our lawyers can provide advice in relation to the GST payable on the sale, stamp duty, revenue law and other implications arising from the transaction.

Contamination Issues

Contamination is a problem for both sellers and purchasers. When selling a property, contamination may be a concern to potential purchasers and may result in a lower sale price. In many cases the key stakeholders have not fully investigated any contamination issues, and are unable to answer crucial questions about the extent or nature of the contamination. In most cases the land owner will be required to make a disclosure to potential purchasers.

A prospective purchaser considering buying a contaminated property should consider not only their personal health position but also their investment and re-sale position. The WMD Property Group can provide legal advice in relation to contaminated property and assist with the performance of further due diligence for the property.
