WMD’s Commercial Litigation Division has extensive experience in negotiating resolution to complex commercial disputes and in conducting commercial litigation in the Local, District and Supreme Courts of New South Wales and the Federal Courts. Our clients range from individuals, local small and interstate businesses to publicly listed companies.

Whether the dispute involves a commercial contract, building or construction issues, failure to pay a debt, Trade Practices Act or Fair Trading Act complaints, a business or partnership breakdown, an insurance claim, a property or lease dispute, a taxation appeal, intellectual property infringements or insolvency and bankruptcy issues, our experienced team has you covered.

Our litigation team provides a practical and commercial focus on resolving disputes and where appropriate, also advises on alternative methods of resolution including negotiation, mediation, conciliation, arbitration, appointment of referees and expert determination.

Insolvency and Bankruptcy

Our experienced team of lawyers can provide commercial advice and conduct litigation in all types of insolvency and bankruptcy matters. We work closely with accountants and financial planners in order to deliver innovative solutions to manage risk and achieve desired commercial outcomes.

WMD regularly acts for and against trustees in bankruptcy and liquidators and administrators of distressed companies to seek to achieve the best possible outcomes for our clients.

Business Sales and Acquisitions

In addition to the Commercial Litigation Division, WMD has a team of professional staff experienced in advising vendors and purchasers of businesses of all types and sizes. Our team is able to advise you on the critical areas for agreement between parties and prepare and negotiate the contract and other associated documents.

The Commercial Division utilises the knowledge and expertise of the WMD Property Group and the Employment Law Division to ensure that all aspects of the sale or purchase are considered.
